By using our Services, you are agreeing to these terms and our privacy policy.
We offer a variety of Services so sometimes additional terms may apply. Additional terms will be available with the relevant Services, and those additional terms will also become part of your agreement with us, if you use those Services. We may modify these terms or any additional terms that apply to a Service to, for example, reflect changes to the law or changes to our Services
Using our Services
- Using InstaParking may include downloading software to your phone. You agree that we may automatically update the InstaParking software, and these terms will apply to any updates.
- Parking Lot and parking restrictions (i.e. lot timings and other lot features) take precedence over any information that you receive from our App. For all the On-Street parking lots, please ensure you are at the parking lot for booking your slot. Prebooking is only only allowed at Off-street, garage and MLP lots.
- All applicable parking rules and regulations apply to you, and your use of the Services does not excuse you from following the rules.
InstaParking Account
You will need an InstaParking account in order to use some of our Services. You may create your own account, or your InstaParking account may be assigned to you by an administrator, such as your employer. When you create your InstaParking account, you must provide us with accurate and complete information. If you are using an InstaParking account assigned to you by an administrator, different or additional terms may apply, and your administrator may be able to access or disable your account.
Limited License to Use Our Services
Subject to your compliance with these terms, InstaParking grants you a limited, non-exclusive, non-sub licensable, revocable, non-transferable license to: (i) access and use our applications on your personal device solely in connection with your use of the Services; and (ii) access and use any content, information and related materials that may be made available through the Services, in each case solely for your personal, noncommercial use. Any rights not expressly granted herein are reserved by InstaParking.
Network Access and Devices
Your mobile network's data and messaging rates and fees may apply if you access or use the Services from your device. You are responsible for acquiring and updating compatible hardware or devices necessary to access and use the Services and any updates. We do not guarantee that the Services will function on any particular hardware or devices. In addition, the Services may be subject to malfunctions and delays inherent in the use of the internet and electronic communications.
Payment
You understand that use of the Services may result in charges to you for the services you receive ("Charges"). We will receive and/or enable your payment of the applicable Charges for services obtained through your use of the Services. Charges will be inclusive of applicable taxes where required by law. Charges may include other applicable fees or processing fees.
As between you and InstaParking, InstaParking reserves the right to establish, remove and/or revise Charges for any or all services obtained through the use of the Services at any time in our sole discretion. We will use reasonable efforts to inform you of Charges that may apply, provided that you will be responsible for Charges incurred under your account regardless of your awareness of such Charges or the amounts thereof.
Penalties
InstaParking through its software, hardware and personal will provide surveillance to your parked vehicle. InstaParking will send notifications informing the details of your parking events including the parking time, additional applicable charges on overstay and penalty charges incurred after due warnings. You are required to pay the applicable fees in order to continue parking in our lots.
Intellectual Property
We reserve all of our intellectual property rights in the Services. Trademarks and logos used in connection with the Services are the trademarks of their respective owners. InstaParking Operator and InstaParking Citizen services are trademarks or registered trademarks of Zruti Solutions Private limited.
Security
We care about the security of our users. While we work to protect the security of your content and account, we can't guarantee that unauthorized third parties won't be able to defeat our security measures. We ask that you keep your information secure. Please notify us immediately of any unauthorized use of your account.
Modifying and Terminating our Services
We are constantly changing and improving our Services. We may add or remove functionalities or features, and we may suspend or stop a Service altogether.
You can stop using our Services at any time. We may terminate or suspend your right to access or use our Services for any reason with or without notice. InstaParking may also stop providing Services to you or add or create new limits to our Services at any time.
Third-party Links
Our Services may contain links to other websites and resources provided by third parties that are not owned or controlled by us. We have no control over the contents of those websites or resources. If you access any third-party content from our Services, you do so at your own risk and subject to the terms and conditions of use for such third-party content.
Disclaimer of Warranties
Our Services are provided on an "as is" basis without warranty of any kind, whether express or implied, statutory or otherwise. We specifically disclaim any and all warranties of merchantability, non-infringement, and fitness for a particular purpose.
